TMZ reports that Gabriel Aubry filed a paternity petition back in December of 2010.
This does not mean that Halle and Gabriel are fighting, but the establishment of paternity will give Gabriel "legal" rights when it comes to spending time with Nahla. In most states, father's rights aren't protected unless the couple was married. That's why baby mommas rule the world...or at least the NBA.
And actually, a source tells TMZ that at least in terms of child custody, visitation or support, Halle and Gabriel pretty much worked that out themselves...with their lawyers. Whatever arrangement they worked out seems to be going along smoothly. Gabriel just wanted to "put it on paper." Nice to see a man running to court to declare he's the father...and not running from it.
